TERMS OF SERVICE FAT BASSET B & T LLC Effective Date: September 5, 2026 Last Updated: September 5, 2026 These Terms of Service ("Terms") are a binding legal agreement between you ("you," "your," or "Customer") and Fat Basset B & T LLC, a company located in Carlsbad, California ("Company," "we," "us," or "our"), governing your access to and use of our website (the "Site") and your purchase of liquid fish attractants, scents, and related fishing accessories (the "Products").

By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use the Site or purchase our Products.

ELIGIBILITY & ACCOUNT REGISTRATION You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or place an order on the Site. By using the Site, you represent that you meet this requirement and that all information you provide is accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.

PRODUCTS & PRODUCT DESCRIPTIONS We make reasonable efforts to accurately describe and display our liquid fish attractants and accessories, including ingredients, scent profiles, and packaging (e.g., biodegradable formula and recyclable packaging claims). However:

Colors, labeling, and packaging may vary slightly from images shown on the Site due to manufacturing batches, screen display settings, or label updates. We reserve the right to modify formulas, packaging, labeling, or discontinue any Product at any time without prior notice. Product availability is not guaranteed and may change without notice. ORDERS, PRICING & PAYMENT All prices are listed in U.S. Dollars and are subject to change without notice. We reserve the right to refuse, limit, or cancel any order at our sole discretion, including orders that appear to be placed by resellers, distributors, or for suspected fraudulent or unauthorized activity. Payment is processed securely through third-party payment processors at the time of order. You represent that you are authorized to use the payment method provided. Applicable sales tax will be calculated and added at checkout based on your shipping destination. In the event of a pricing or listing error, we reserve the right to cancel the order and issue a full refund. SHIPPING & DELIVERY Orders are shipped via third-party carriers (e.g., USPS, UPS, FedEx) to the address provided at checkout. You are responsible for ensuring your shipping address is accurate and complete. Because our liquid fish attractant Products may be classified as scented/liquid consumer goods, certain shipping methods, carriers, or destinations (including international shipments) may be restricted or subject to additional handling requirements. Estimated delivery times are provided for convenience only and are not guaranteed. We are not responsible for carrier delays, lost packages, or damage occurring during transit once the package has left our facility, though we will assist in good faith with carrier claims. Risk of loss and title for Products pass to you upon our delivery to the carrier. RETURNS, REFUNDS & CANCELLATIONS Due to the nature of liquid attractant Products, opened, used, or leaking bottles are NOT eligible for return for health, safety, and re-sale reasons, except where required by law or due to a defect covered under Section 11. Unopened, unused Products in original packaging may be returned within [insert number] days of delivery for a refund or exchange, subject to a restocking fee if applicable. To initiate a return, contact us using the information in Section 19 to receive return instructions and, if applicable, a return authorization. Shipping charges are non-refundable, and return shipping costs are the responsibility of the customer unless the return is due to our error or a defective Product. Orders may be canceled or modified only before they have been processed for shipment. Contact us as soon as possible if you need to change or cancel an order. PRODUCT USE, SAFETY & DISCLAIMERS Our liquid fish attractants are intended solely for use as fishing bait/scent enhancers in accordance with the instructions provided on the product label. Products are not intended for human or animal consumption, and are not a food, drug, or cosmetic product.

Follow all label instructions and safety warnings. Keep Products out of reach of children and pets. Do not ingest. In case of accidental ingestion, skin contact, or eye contact, follow the first-aid instructions on the product label and seek medical attention if needed. We are not responsible for misuse of Products or use inconsistent with label instructions. Sustainability claims (e.g., "biodegradable formula," "recyclable packaging") describe the Product/packaging as manufactured and are based on our current formulation and packaging materials; actual biodegradability and recyclability may depend on local environmental conditions and regional recycling program availability. FISHING REGULATIONS DISCLAIMER Fishing regulations, including permissible bait types, scents, and attractants, vary by state, region, waterway, and season. It is your sole responsibility to know and comply with all applicable local, state, and federal fishing laws and regulations before using our Products. Fat Basset B & T LLC is not responsible for fines, penalties, or legal consequences resulting from the use of our Products in violation of applicable fishing laws or regulations.

INTELLECTUAL PROPERTY All content on the Site — including but not limited to text, graphics, logos, product labels, images, videos, and the Fat Basset B & T LLC name and branding — is the property of the Company or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on the Site without our prior written consent, except as necessary to view the Site for personal, non-commercial shopping purposes.

USER CONDUCT & PROHIBITED USES When using the Site, you agree not to:

Violate any applicable local, state, federal, or international law or regulation; Use the Site for any fraudulent or unauthorized purpose, including reselling Products without authorization; Attempt to gain unauthorized access to the Site, our servers, or any connected systems; Introduce viruses, malware, or other harmful code; Scrape, harvest, or collect data from the Site using automated means without our written consent; Impersonate any person or entity or misrepresent your affiliation with any person or entity; Interfere with or disrupt the Site's functionality or servers/networks connected to the Site. REVIEWS & USER CONTENT If you submit a product review, testimonial, comment, or other content ("User Content") to the Site, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and distribute such User Content in connection with our Products and marketing, including on the Site and social media.

You represent that your User Content is truthful, does not infringe any third-party rights, and does not contain unlawful, defamatory, or offensive material. We reserve the right to remove any User Content at our sole discretion.

WARRANTY DISCLAIMER EXCEPT AS EXPRESSLY STATED, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW, FAT BASSET B & T LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR PURCHASE OF PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

INDEMNIFICATION You agree to indemnify, defend, and hold harmless Fat Basset B & T LLC and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Site or Products; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party right, including fishing regulations.

THIRD-PARTY LINKS & SERVICES The Site may contain links to third-party websites, payment processors, or shipping carriers. We do not control and are not responsible for the content, policies, or practices of any third-party sites or services. Your use of third-party services is subject to their own terms and privacy policies.

GOVERNING LAW & DISPUTE RESOLUTION These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of such courts.
